gifted learning lab client information & service agreement

Welcome and thank you for considering The Gifted Learning Lab LLC (“The Company” or “Parent Coach”) for parent coaching. This document contains important information about our professional services and business policies, if you (“You” or “Client”) decide to work with The Company. 

 

You are asked to review this document before you register and pay for any coaching program with The Gifted Learning Lab.  You will also be required to review & sign this document electronically before beginning the program.

As with any coaching experience, there are terms and conditions that apply to your experience. We’ll be as brief as our attorney will allow. The main thing to remember is that by using our services, you agree to the terms set forth below along with the Company’s Terms of Use and Privacy Policy for www.giftedlearninglab.com. Services shall not be rendered if you do not accept this Agreement.

 

Parent Coaches – Agents of Company

The Parent Coach is engaged in providing parent coaching services to clients directly through the Company.  The Parent Coach and all other Company agents are acting in their capacities under the Company, and nowhere in this agreement is the Parent Coach or any other agents acting in their individual capacities. 

Description of Coaching

Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that helps the client strive towards their personal goals as a parent. Coaching is designed to facilitate the creation and development of personal and familial goals and to develop and carry out a strategy or plan for achieving those goals.

 

The Coach-Client Relationship

A. Client is solely responsible for creating and implementing their own decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands that coaching is not therapy and does not substitute for therapy if needed.  Client further understands that coaching does not prevent, cure, or treat any mental disorder or medical disease.

 

B. Client acknowledges that parent coaching is a comprehensive process that may involve different areas of their life, including work, finances, health, relationships, education and recreation. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas, and implement choices is exclusively the Client’s responsibility.

C. Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals.  Client acknowledges that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed. If Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach.

D. The Client understands that in order to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance, and create the time and energy to participate fully in the program.

 

Description of Services: Support Your Intense Gifted/2e Kid

Support Your Intense Gifted/2e Kid is a small-group coaching experience that lasts 8 weeks. Up to 15 families can enroll in each cohort, with up to 2 participating adults per family. Each component of the program is described briefly below.

Philosophy. The learning lab process used in this coaching program relies on your active participation and reflection. After learning new ideas, you are encouraged to apply these ideas to your unique situation, try new approaches at home, observe the results, reflect on what happened, and adapt strategies and principles as needed until you find what works for you and your family. You have several ways to access coaching and support during the program, as described below.

 

Learning Lab meetings. Each small-group interactive lab meeting is 90 minutes long and takes place on Zoom. During each lab meeting, Danika will introduce new information about giftedness, twice-exceptionality, or intensity, as well as new principles and strategies to support your child and your parenting.

You are encouraged to use a journal or computer document to respond to Danika’s prompts and guided reflections, adapt strategies to your family, collect helpful ideas, & make a plan to try out new strategies.

During each lab meeting there will be time for Q&A and small-group coaching so you and other participants can ask clarification questions and get help adapting the principles and strategies to your unique situations. There may not be time to answer all participants’ questions during lab meetings.

If you miss a meeting, you can watch the recording for up to six months after the program ends (see “Private online network” below).

On rare occasions, lab meetings may need to be rescheduled.  You will be given as much notice as possible.  There are no partial refunds for missed or rescheduled lab meetings.  If you are not able to attend a lab meeting for any reason, you can access the recording for six months after the program ends.

Private online network. As a participant in Support Your Intense Gifted/2e Kid, you will receive access to a private online network with Danika Maddocks and the other program participants.

All lab meetings will be recorded and recordings will be posted in the private network to be available on-demand for up to six months after the program ends (barring recording errors or technical difficulties). After the lab meeting each week, Danika will also post copies of the week’s guided reflections and slides in your group network. You will have access to everything in your group network for six months after the program ends. You can download copies of Danika’s slides and guided reflections to keep a copy forever.

You can interact with other participants in the private network and offline if you decide to do so. You are encouraged but not required to interact with your group labmates outside of the program.

Between lab meetings. Between weekly lab meetings, you are encouraged to apply and try what you’ve learned in the lab meetings. Trying ideas at home will help you learn what works best or does not work well for you and your family.  Parenting is complex and each child and family are different.

As questions arise between meetings, you have two options for support: office hours and the group network.

 

Office hours: Danika will answer questions live for 60 minutes during office hours. Office hours will be held on Zoom.  You'll have access to the recordings for six months (barring any technical difficulties).

On rare occasions, office hours may need to be rescheduled.  You will be given as much notice as possible.  There are no partial refunds for missed or rescheduled office hours.  If you are not able to attend the office hours at the new time, you can still submit questions in the online network. You can also access the recording of the office hours for six months after the program ends.

The group network: In the group’s private online network, you can share challenges, successes, and questions with your fellow labmates.  You can also post questions for me in our group network and I will post a video answering posted questions once per week.

Private coaching calls.  Each family can schedule two 45-minute private coaching calls during the program.  These private coaching calls take place virtually and are not recorded. These calls are not therapy and are not a substitute for mental health treatment.​

You are encouraged to schedule your first private coaching call as soon as possible so Danika can learn more about your goals and you can get the most out of the program.  Participants can choose from available time slots offered by Danika.  Most time slots are between 9am and 4pm PST, with some evening slots available.  Danika will offer a range of available times but cannot guarantee that participants will find a time that works for them.

Fees.  The Spring 2024 fee for Support Your Intense Gifted/2e Kid, the 8-week group coaching program, is $2125 for early bird registration and $2325 for regular registration.  Two low-fee spots are also available and will be selected in a random drawing.  The low-fee spot for the Spring 2024 cohort costs $800.  A five-month payment plan is available for no additional charge for all participants. 

 

Payments are processed securely in Thrivecart.  You must complete your first payment to enroll in the program. There are no refunds once lab meetings or the initial private coaching call have begun. If you would like a refund before the program begins, please contact us at danika@giftedlearninglab.com the day before your program's start date and before scheduling a private coaching call.

The Parent Coach will look to you for full payment of your account, and you will be responsible for payment of all charges. The Company does not accept health insurance.  Company reserves the right to terminate services with you at any time, without notice.

Description of Services: Alumni Monthly Coaching Group

Monthly small-group discussion and group coaching meeting for parents who have completed Parenting Your Intense Gifted Kid.

Philosophy. The coaching process relies on your active participation and reflection. After discussing new ideas, you are encouraged to apply these ideas to your unique situation, try new approaches at home, observe the results, reflect on what happened, and adapt strategies and principles as needed until you find what works for you and your family.

Live coaching calls.  Your small group will meet once per month for small group coaching.  Topics will be decided collaboratively by the group and Danika. Danika will moderate the discussion and provide coaching and feedback in the group context.  Monthly meetings will last 60 minutes.

Monthly meetings will be recorded.  You will have access to the recordings in Mighty Networks for 3 months following the end of the discussion group.

On rare occasions, group discussion meetings may need to be rescheduled.  You will be given as much notice as possible.  There are no partial refunds for missed or rescheduled meetings.  If you are not able to attend the discussion meeting at the new time, you can access the recording.

Asynchronous coaching in Mighty Networks.  Your family can submit questions two times per month in Mighty Networks and Danika will provide asynchronous coaching in video or written format.  You can submit multiple questions each time, either in writing or in a video format (not to exceed 5 minutes).

The group network.  Your monthly coaching group will have a private space in Mighty Networks where you can share challenges, successes, and questions with your fellow discussion group members.  

Fees.  The fee for the 6-month Alumni Monthly Coaching Group is $800 per family.  A 5-month payment plan is available for no additional charge.  Payments are processed securely in Thrivecart.

There are no refunds once the initial meeting has begun.  If you would like a refund after enrolling and before the initial meeting, please contact me at danika@giftedlearninglab.com.  However, each discussion group will only run if at least 3 families enroll.  If you enroll and pay but the group does not have enough participants to run, your payment will be refunded in full.

Description of Services: One-time Private Coaching Calls (45 minutes)

This is a private virtual coaching call that lasts 45 minutes. These calls are only available for parents who have completed Support Your Intense Gifted/2e Kid or Parenting Your Intense Gifted Kid. Each call is scheduled individually. When you schedule the call, you are asked to provide information about the specific questions, topics, or concerns you would like to address during the call. Depending on the complexity of the questions and the amount of discussion required, there may or may not be time to address all your questions. You are welcome to schedule additional private calls if desired.

A video of your private coaching call will be available for one week if you would like to revisit the material or share the recording with a parent who cannot be present during the call.

Philosophy. The coaching process relies on your active participation and reflection. After discussing new ideas, you are encouraged to apply these ideas to your unique situation, try new approaches at home, observe the results, reflect on what happened, and adapt strategies and principles as needed until you find what works for you and your family.

Fees.  The fee for a 45-minute coaching call is $165.  If you need to cancel or reschedule your meeting, please let me know at least 24 hours in advance.  If you are ill or have an urgent situation the day of our meeting, please let me know as soon as possible.  No-shows will be charged a $35 fee.

Mandated Reporting

Under certain State Laws, persons are mandated to report suspected child abuse or neglect. Persons who work with children and families are in a position to help protect children from harm. These persons may be required by law to report to child protection if they know or have a reason to believe that a child is being abused or neglected or that a child has been neglected or abused within a certain timeframe. As a mandated reporter, the Parent Coach may be required to report certain information to the appropriate authorities. 

Risks of Parent Coaching Services and Limitation of Liability

You are responsible for lifestyle choices or changes that may result from parent coaching and participation in The Company’s programs. There are no guarantees in providing coaching services and the Parent Coach and its agents do not make any guarantees with this agreement.  You assume the risk of coaching services by reading and signing this form.  The Parent Coach is not liable for any adverse reactions to providing coaching services. THE PARENT COACH’S AGGREGATE LIABILITY SHALL, IN ALL CASES, BE LIMITED TO THE AMOUNT PAID BY YOU TO BE A PARTICIPATING CLIENT OF THE PARENT COACH. The Parent Coach may take any reasonable action necessary while providing coaching services when there is a dangerous circumstance, as determined by the Parent Coach. The Parent Coach cannot give healthcare advice.  No advice provided by the Parent Coach is medical advice.  You should consult with your healthcare professional to get medical advice.  Seeing a Parent Coach does not replace medical advice or the relationship with your healthcare provider. 

 

Paperwork and Coordination with Other Professionals

The Company and the Parent Coach do not fill out administrative paperwork, do not provide written reports or recommendations for individual clients or their children, and do not coordinate or communicate with other professionals about participants in the coaching program or those participants’ children.

After-Hours Emergencies

Please know that the Parent Coach does not provide twenty-four (24) hour crisis or emergency health services. Should you or your child experience an emergency necessitating immediate health attention, immediately call 911 or if you are able to safely transport yourself or your child, go to the nearest hospital emergency room for assistance.

Contacting Your Parent Coach

The Parent Coach is not immediately available to contact and the method of contact will be made clear for the particular services or program you choose.  See “Description of Services” above for details about how to communicate with your Parent Coach during your program.

Audio and Video Recordings

You acknowledge and, by signing this information and consent form below, agree that the Parent Coach may record any part of your meetings and posting these recordings in your coaching group’s private online network. You further acknowledge that the Parent Coach objects to you recording any portion of your sessions without the Parent Coach’s written consent.  

 

Defamation

By signing this intake and consent form below you agree that you will not make defamatory comments about the Parent Coach or its agents to others or to post defamatory commentary about the Parent Coach on any website or social media site. In the event that defamatory remarks about the Parent Coach or its agents are made by you, or others acting in concert with you, you further consent by signing this intake and consent form below to allowing the Parent Coach and its agents to use confidential information necessary to rebut or defend against, or prosecute claims for, the defamation.

 

Privacy and Security of Communications

All electronic communications between you and the Parent Coach will be transmitted using reasonable measures to ensure confidentiality. You will be responsible to secure and protect the functionality, integrity, and privacy of your hardware, files, and communication. Password protection for accessing your hardware and files is recommended. If others will be accessing the same computer, be aware that programs exist that copy every keystroke you make. 

 

Legal

This Agreement shall be construed in accordance with, and governed by, the laws of the State of Minnesota as applied to contracts that are executed and performed entirely in Minnesota. The exclusive venue for any court proceeding based on or arising out of this Agreement shall be Hennepin County, Minnesota.  The parties agree to attempt to resolve any dispute, claim or controversy arising out of or relating to this Agreement by mediation or any other procedure upon which the parties may agree. The parties further agree that their respective good faith participation in mediation is a condition precedent to pursuing any other available legal or equitable remedy, including litigation, arbitration or other dispute resolution procedures. If any legal action or any mediation or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable attorneys’ fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled. Electronic copies of this Agreement and electronic signatures have full effect and legal validity. 

 

Client Bill of Rights

I am pleased to provide you with this Client Bill of Rights, in accordance with Minnesota laws governing complementary and alternative health care practices.

 

In accordance with Minnesota law, I am providing you with the following notice:

 

1. Name, title, business address, and telephone number: Danika Maddocks is the owner and Parent Coach at the Company. She does not have a supervisor.  Through Company, Danika Maddocks practices parent coaching, generally electronically, at 2136 Ford Parkway #5306 Saint Paul, MN 55116. There is no telephone number for The Gifted Learning Lab.  Danika can be reached by email at danika@giftedlearninglab.com

The parent coach is engaged in providing services to clients directly through the Company. The parent coach is acting in her capacity under Company, and nowhere in this agreement is the parent coach acting in her personal capacity.

 

2. Degrees, training and experience. I, Danika Maddocks, have over 12 years experience as an educator and 7 years experience as a therapist and assessment provider, with a special interest in gifted and twice-exceptional children and their families.  In my private practice, I have focused on supporting gifted and twice-exceptional children and their families.  I research and write about giftedness and twice-exceptionality as well as supportive parenting practices.  I have graduate training in child development and school psychology.

 

THE STATE OF MINNESOTA HAS NOT ADOPTED ANY EDUCATIONAL AND TRAINING STANDARDS FOR UNLICENSED COMPLEMENTARY AND ALTERNATIVE HEALTH CARE PRACTITIONERS. THIS STATEMENT OF CREDENTIALS IS FOR INFORMATION PURPOSES ONLY.

 

Under Minnesota law, an unlicensed complementary and alternative health care practitioner may not provide a medical diagnosis or recommend discontinuance of medically prescribed treatments. If a client desires a diagnosis from a licensed physician, chiropractor, or acupuncture practitioner, or services from a physician, chiropractor, nurse, osteopath, physical therapist, dietitian, nutritionist, athletic trainer, or any other type of health care provider, the client may seek such services at any time.

 

3. Right to file a complaint. You may file a complaint with Danika Maddocks by writing your complaint and sending the complaint to Danika Maddocks’s listed business address in Section 1.

 

You also have a right to file a complaint about an unlicensed complementary or alternative health care provider by contacting the following state office:

4. Fees for unit of service. The fee for the Support Your Intense Gifted/2e Kid program is $2125.  The fee for the Mastermind is $2100.  A monthly payment plan is available for no additional charge. You must complete your first payment to enroll in either program. There are no refunds once meetings for your program have begun. We do not accept health insurance or Medicare or medical assistance.  If you would like a refund before the program begins, please contact The Company at danika@giftedlearninglab.com the day before your program's start date. 

There are no partial refunds for missed or rescheduled live meetings.  If you are not able to attend the live meeting at the new time, you can access the recording for six months after the program ends.

5. Change in services or charges. You have a right to reasonable notice of changes in services or charges, and the Parent Coach will provide prior notice of any changes.

 

6. Description of Services. Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that helps the client strive towards their personal goals as a parent. Coaching is designed to facilitate the creation and development of personal and familial goals and to develop and carry out a strategy or plan for achieving those goals.

7. Information about assessment and recommended service. You have a right to complete and current information concerning any assessment and recommended service, including the expected duration of the service to be provided. If you have any questions, please ask. 

 

8. Confidentiality. Your records and other information about you are confidential. This information will not be released, unless you authorize release in writing, or unless release is required by law.

 

9. Access to client records. You are allowed access to records and other written information, in accordance with Minnesota Statutes, sections 144.291 to 144.298.

 

10. Courteous treatment. You can expect courteous treatment and to be free from verbal, physical or sexual abuse by the practitioner.

 

11. Other available services. If you are interested in other available services in the community, you may wish to ask your practitioner or consult one of various available private directories of alternative practitioners in Minnesota.

 

12. Change of practitioners. You have the right to choose freely among available practitioners and to change practitioners after services have begun.

 

13. Coordinated transfer. If you change practitioners, you have the right to my assistance in coordinating the transfer to another practitioner.

 

14. Refusing services. You have the right to refuse services or treatment, unless otherwise provided by law.

 

15. No retaliation. You may assert your rights without retaliation.

 

Consent to Services

I, voluntarily, agree to receive parent coaching services and authorize the Company to provide such services as are considered necessary and advisable.

I understand and agree that I will participate in the planning of my care or services, and that I may stop such care or services that I receive through the undersigned Parent Coach at any time.

By agreeing to this Client Information and Consent form, I acknowledge that I have read, understood, and agreed to be bound by all the terms, conditions, and information it contains. Ample opportunity has been offered to me to ask questions and seek clarification of anything unclear to me.

Group Confidentiality

As evidenced by my accepting the terms and conditions of this contract, I agree to participate in group coaching if I am participating in Support Your Intense Gifted/2e Kid or the Mastermind. I acknowledge that, with group coaching, there is risk of disclosure of confidential information by persons in the group to individuals outside of the group. I agree that I will not disclose information learned by me during the course of any group session and will protect each participant's right to confidentiality. I agree to hold the Company harmless from any claims or liability resulting from my disclosure of confidential information to a third party outside of a group session. I further agree not to hold the Company responsible and release them from the same, for/from any claims or liability that I could assert as a result of disclosure of my confidential information by participants in my group coaching sessions.

 

I understand I may choose to discontinue group coaching at any time.
